Text= Jaguarwoman Designs Extended License For Commercial Use Scrapbooking Kits: This license should be included within the zipfile of any product created with the use of my original design resources. This license is granted solely to the purchaser of a specific product. If you would like to use other design resource products by Jaguarwoman Designs for designing scrapbooking products for commercial sale (CU, P4H), you must buy a separate license agreement for that purpose. You must understand and agree to my Terms of Use and license in order to buy products in my store. If you read anything here that you don't understand, write me at jaguarwoman@jaguarwoman.com and ask for further explanation. Firstly . . . The license is not a transfer of ownership of the original images, but specifies that the licensee has aquired the right to use the images in SCRAPBOOKING PRODUCTS FOR COMMERCIAL SALE, under specific circumstances, which may differ according from the licensing provisions for other Jaguarwoman products. The copyright is not being transferred to the licensee and Jaguarwoman Webdesign continues to own images, granting the right to use them in specific circumstances, such that the basic right of the original artist to profit from them is preserved. Secondly . . . As in the case of software, the license is not transferrable. A customer may not redistribute or share the product files in any venue, online or offline. More specifically, the licensee may not redistribute any part of the product, for profit or for free, through filesharing groups and thereby deprive the original owner of the images of the rightful profit of their labor. Instances of filesharing or digital piracy of the original products, if uncovered, will result in the instant revocation of the license, banning from my store, legal action, and potentially additional penalities. DIGITAL SCRAPBOOKING PRODUCTS, GENERAL STIPULATIONS & RESTRICTIONS: All my products other than my tutorials may be used for commercial scrapbooking products the the holder of this license. The elements may not be redistributed or given away in filesharing groups offline or online. It is a copyright violation to repackage my design elements for resale or redistribution even with changes, even as a "freebie", or even privately within a filesharing group. The images may not be repackaged, even with changes, and resold individually or in collections which may then compete with the original product in the open market. They may only be used to create genuinely new, derivative designs by the licensee. This stipulation about the use of images "as is" includes the case where an individual element may be re-colored or hue-shifted. Also, changes in a design element which do not significantly change the footprint or the appearance of the image are not considered "derivative design". (Please see my discussion of in my Terms of Use page regarding "derivative design", at http://www.jaguarwoman.com/jagderivativedesign.html). In short, only I can sell my own work as an original design resource or merchant resource. The buyer of the license can use them commercially as a design resource in which the original images are physically incorporated into the licensee's design as a "derivative design". In this case, with scrapbooking kit designs, the original image must be merged with a functional scapbooking element such as a frame, cluster frame, a vignette composed of multiple elements and merged together, a merged background collage, a tag in which the image resource is merged to the tag, merged with other images in a cluster frame or border design. These derivative designs may be sold, but the licensee may not resell the original work as a standalone design element in on a transparent background (such as png or psd file format). SPECIFIC PERMISSIONS AND RESTRICTIONS: What the licensee of this product may NOT do: You MAY NOT provide or re-sell any individual element in a Jaguarwoman product as a freestanding image (by itself in a png or psd file) for commercial purpopses, for CU, C4H, or CU as CU, even if modified. You MAY NOT share any part of the product with friends and colleagues for the purpose of collaborative design. YOU MAY NOT add add any of the product images to your own freebies. YOU MAY NOT share individual images or entire products, online or offline, with friends, colleagues or the public, in clubs or filesharing groups YOU MAY NOT alter and claim my images as your own; credit is not required from the licensees who are creating derivative designs, but doesn't hurt. You MAY NOT upload any of the images, either in their original form or in the form of derivative designs to scrapbooking software publishing websites for mass publishing/printing purposes What the licensee of this product MAY DO: You MAY use the individual design elements from Jaguarwoman products to create derivative designs for scrapbooking products/kits in the form of frames, cluster frames, vignettes, border art, decorative embellishments, quickpages, background papers & collages, journaling tags, banners, album covers and other functional scrapbooking design elements, to sell to a third party for PERSONAL USE, provided that your product is in a merged, flattened condition and not sold as a Commercial Use design resource itself in direct competition with the original product resources licensed from Jaguarwoman Designs. Regarding new usages which may arise in the future or usages I may have overlooked . . .I reserve the right to interpret the basic license in the future in a way that protects my copyright and position as the author of my own work appropriately, so that customers may use products for derivative design but not resell the products in a way that damages my position as the author of the original works. If you think of a new usage for my image resources that are not covered by this license, email jaguarwoman@jaguarwoman.com, with screenshots of your usage. Do NOT send me entire product files to download, unzip, and study on your behalf. People often ask why TOUs are permitted to changes at all. Changes in usage happen daily. When artists create works, within weeks, there are usages that arise that were never imagined when the artists first painted or rendered something. We constantly have to cope with new ways in which our work(s) can be exploited that we didn't foresee.
